PERAN UNIT TIPIKOR DALAM PENYIDIKAN PENYALAHGUNAAN DANA DESA PERSPEKTIF FIQIH SIYASAH

This research examines the function of the Corruption Crime Unit (Tipikor) within the Criminal Investigation Division of the North Bengkulu Police in addressing corruption cases involving village funds in North Bengkulu Regency. In addition, it evaluates the implementation of its duties through the lens of Fiqh Siyasah. The study applies an empirical legal approach with a qualitative design. Data were obtained through observation, interviews, and documentation from both primary and secondary sources, and were subsequently analyzed using descriptive qualitative techniques. The findings indicate that the Tipikor Unit has implemented its responsibilities through a combination of pre-emptive, preventive, and repressive measures, along with investigative procedures grounded in applicable legal provisions. During the 2023–2025 period, the unit managed six cases of village fund corruption and processed twenty-three reports of alleged corruption that are still under investigation. Nevertheless, the level of effectiveness in these investigations remains suboptimal. This condition is influenced by several factors, including recurring irregularities in village fund management, limited human resources and investigative competence, insufficient facilities and infrastructure, weak inter-agency coordination, and low levels of legal awareness among village officials and the community. Viewed from the perspective of Fiqh Siyasah, the role of the Tipikor Unit embodies the principles of amanah (trustworthiness), al-‘adl (justice), and maslahah ‘ammah (public welfare). It contributes to safeguarding public finances, strengthening accountability in village fund governance, and fostering a transparent and corruption-free village administration system.
